About the role

The General Counsel plays a critical role within this organization, reporting directly to the Chief of Corporate Affairs. This position is responsible for providing professional legal advice and services to all areas, including executive committees and senior leaders. The General Counsel leads and coordinates activities to achieve the Organisation's objectives in the provision of legal services.

Key Responsibilities:
  • Provide legal services and medico-legal support regarding Coronial and litigation matters.
  • Assist in the preparation of statements for staff in relation to inquests and other legal proceedings.
  • Provide legal advice and input into the management of adverse events and complaints.
  • Develop and maintain a legal compliance framework 
  • Provide legal advice regarding tender, contracts, commercial and service agreements, and partnership agreements.
  • Stay updated on all current and new legislation affecting the organization and its impact on service delivery.
  • Provide legal advice regarding Freedom of Information requests and privacy issues.
  • Educate employees, particularly clinical staff, about medico-legal issues and risk management.
  • Oversee the outsourcing of legal work and ensure contracted services are high quality and within budget.
  • Attend and report on meetings, executive committees, and board meetings.
Ensure Legislative Compliance:
  • Advise the organization on its rights and obligations under legislation and statutory instruments.
  • Inform the organization of new legislation that may affect its activities.
  • Undertake legal risk management activities to ensure compliance.
Oversee Insurance Matters:
  • Provide advice and guidance to staff regarding insurance matters.
  • Maintain a corporate relationship with Victorian Managed Insurance Authority (VMIA).
  • Develop an understanding of the insurance coverage provided or excluded and monitor changes.
Qualifications and Experience
  • Relevant undergraduate qualifications with entitlement to practice in New South Wales and Victoria jurisdictions and hold a current practicing certificate for at least five (5) years.
  • Demonstrated ability to provide practical legal advice within a complex environment.
  • Skills in conflict resolution and litigation.
  • Skills in drafting complex contracts, service agreements, and partnership documents.
  • Ability to consult and collaborate effectively.
  • Excellent communication skills, both written and verbal.
  • Knowledge and experience of the law relating to the Victorian/New South Wales Public health sector (desirable).
